Terms & Conditions

Information published on this web site is provided for the use of its visitors and you are advised that, although care has been taken to ensure technical and factual accuracy, some errors may occur. No guarantee is given of the accuracy or completeness of information on these pages. Please be aware that Apex Gym may alter the information on its web site from time to time. 

By joining Apex you agree to use the Apex facilities in accordance with the company’s Terms and Conditions as displayed on their website or premises and as set out in this document. Where these differ, the terms and conditions in this document supersede those elsewhere.

Apex accepts no responsibility for any lost or stolen property at our premises. Any items left at Apex will be kept for 2 weeks before being disposed of.

HEALTH

You participate in classes and personal training sessions entirely at your own risk and should seek medical advice should you have any concerns. By participating in an Apex class, you are confirming that you do not suffer from health problems that would hinder exercise or prevent you from engaging in exercise, or that would be detrimental or adverse to your health, safety or physical condition if you did exercise. In case of any doubt, you shall seek advice by a medical doctor who should confirm the ability to exercise. Apex shall have no obligation to perform a fitness assessment or similar testing to determine your physical condition. If an assessment is done at Apex, it is for the sole purpose of compiling comparative data in order to track your progress in a programme and not for diagnostic purposes.

MEMBERSHIP FEES

The joining fee is taken with immediate effect and the first weekly membership is taken on the first day of your membership as agreed upon joining. Please note that your membership is an eight-week rolling contract and payments are taken weekly in advance on the same day each week.

If you have a Basic Membership, the day the payment is taken also corresponds to the day your class credits reset. You cannot roll-forward credits to the next week if unused.

From time to time, we may need to increase the price of the membership. We will give you at least one full month's notice of any price increase and when it will take effect. During this period, you will have your usual right to terminate your membership in accordance with the membership terms and conditions.

 

 

MEMBERSHIP CANCELLATION

After the initial 8 week contract, a 3 week written notice is needed for membership cancellation.

In exceptional circumstances, a membership can be paused (for example serious injury or illness). In such circumstances, a written doctors note will need to be provided for proof of injury or illness. A paused membership cannot take place in the first eight (8) weeks and must be for a minimum 3 weeks and maximum 6 months. We can only pause memberships with an agreed end date. If during your pause you decide you want to cancel, you must pay your three week notice period. There is a maximum of 2 membership pauses per year.

Any changes to memberships must be requested in writing by emailing Apex Gym. Any changes to your Membership option restarts the 8-week contract period.

CLASS NO SHOWS

A small fee of £3 will incur to any no shows of classes that members are booked on. 

PRIVACY & SECURITY POLICY

At Apex we take your privacy seriously and we will never sell or rent your personal data to any third party. Sharing of your data and direct marketing actives are only carries out with your explicit consent, which you are free to withdraw at any time.

We need to obtain and process your personal data to provide you with updates to changes to class times and any new offerings we may have and to fulfil our business legal obligations. We will never collect any personal information from that we do not need or retain any data that is no longer necessary for the purposes specified in this notice. Where we request sensitive personal data from you, i.e health or medical data, the reasons for the request will be clearly given along with the purposes of the processing. Explicit consent through a signature will always be required for us to obtain and process your health information.
